Controller
The controller for goldenplanet.dk and goldenplanet.com and for our customer relationships is Golden Planet ApS, CVR no. (Danish company registration number) 26991714, Dalbygade 40 A, 6000 Kolding, Denmark. Email: info@goldenplanet.com, telephone: +45 70 20 95 94.
When you are our customer
We need the following information when you buy from us: company name, contact person, address, telephone number, email address and company registration number (CVR no.). We also record which services you have ordered, your invoices and payments and your enquiries to us.
We use this information to provide and invoice our services, provide support, manage the customer relationship and comply with the Danish Bookkeeping Act (bogføringsloven). If you are yourself a party to the contract, the legal basis is our contract with you (Article 6(1)(b) of the General Data Protection Regulation). We process information about companies' contact persons on the basis of our legitimate interest in managing the customer relationship (Article 6(1)(f)). We process accounting records in order to comply with our legal obligation under the Bookkeeping Act (Article 6(1)(c)).
If you pay by card, the payment is processed by a payment service provider, which processes the card details.
If you order a domain name, we pass the registrant information required for the registration to the registrar or registry that administers the domain (for .dk domains, Punktum dk). This is necessary in order to register the domain, and the registrar or registry is a controller in its own right for its processing.
When you fill in a form on our website
When you use a form on the website – for example to place an order, get a free demo, ask us to call you back or send us details of a task – we store the information you enter, any attached files, your IP address, information about your browser and the time. We use this information to handle your order or enquiry and to protect the forms against spam and misuse. The legal basis is that the processing is necessary in order to take steps at your request prior to entering into a contract with you (Article 6(1)(b)) and otherwise our legitimate interest in answering enquiries and preventing misuse (Article 6(1)(f)).
When you visit the website
When you visit the website, our server records your IP address, the time, the page you visit and information about your browser. This is done for operational and security reasons (our legitimate interest, Article 6(1)(f)).
Searches in the website's search function are stored without an IP address or any other information about who searched. If you type personal data into a search yourself, it is stored as part of the search.
If you give feedback on a guide in our support centre, we store your answer, any comment, information about your browser and a pseudonymised value (a hash) of your IP address. We use the feedback to improve our guides and the hash to prevent misuse (Article 6(1)(f)). The hash is still personal data.
Visitor statistics
We compile statistics on how the website is used on our own server at Hetzner. When you open a page, we record the address of the page, the time, the website you came from (if any), your browser, operating system and type of device, and the country and network your IP address belongs to. The IP address itself is not stored: we store only hashes of it (alone and together with your browser's name), made with a random key that changes every day and is deleted after 2 days, so that afterwards the hashes can no longer be traced back to your IP address. The detailed information is deleted after 35 days; after that we keep only daily totals.
We do not use cookies or store anything on your device for the statistics. Hetzner is our processor, and the servers are located in the EU only; otherwise we do not disclose the information to anyone. The legal basis is our legitimate interest in knowing how the website is used and in keeping it secure (Article 6(1)(f)).
When you use the chat
The website has a chat provided by Intercom. The chat is only loaded when you click the chat button: until then nothing is fetched from Intercom and no cookies are set. When you open the chat, we and Intercom process what you write, your name and email address if you provide them, and technical information such as your IP address, information about your browser and device, your language and the page you are writing from. We use the information to answer your questions and to give you support and advice. The legal basis is that the processing is necessary to answer your enquiry and, where relevant, to enter into a contract with you at your request (Article 6(1)(b)), and otherwise our legitimate interest in answering enquiries (Article 6(1)(f)).
Once you have opened the chat, your browser remembers this for 30 days (in the browser's local storage), so that the chat is also loaded on the next pages you visit and the conversation can continue.
Cookies
The website only uses cookies that are strictly necessary to provide what you ask for – for example a security cookie on pages with forms, a cookie for the basket in our domain search and the chat's cookies once you have opened the chat yourself. Such cookies do not require consent. We do not ourselves use cookies or other technologies that store or read information on your device for statistics, marketing or tracking visitors. Our visitor statistics are counted on our own server (see Visitor statistics above).
If you open the chat, Intercom sets cookies (intercom-id-*, intercom-session-* and intercom-device-id-*) and stores information in the browser's local storage, so that the chat can recognise your browser and the conversation can continue when you move to another page or come back later. This only happens once you have opened the chat yourself, and it is used only for the chat – not for statistics or marketing. intercom-session-* lasts up to one week, intercom-id-* and intercom-device-id-* up to 9 months.
Videos from YouTube and Vimeo are only loaded when you click play. When you do so, your IP address, among other things, is passed to YouTube (Google) or Vimeo, which may set cookies under their own rules. The provider is itself responsible for its further processing of the information.
Recipients and processors
We only pass on information where this is necessary for the purposes above. This may, for example, be to domain name registrars, payment service providers, our advisers and public authorities where the law requires it. Some of these recipients are controllers in their own right for their processing.
In addition, we work with a number of other companies that store and process data on our behalf (processors). The website is hosted by Hetzner Online GmbH on servers in Finland, and backups of the website are stored with Google (Google Drive in our Google Workspace, covered by Google's data processing terms). The servers and backups of the e-commerce platform are located with Hetzner Online GmbH in Germany. The chat on the website is provided by Intercom R&D Unlimited Company, Ireland, with Intercom, Inc., USA, as a sub-processor. Our other processors are providers of IT operations and IT tools, for example for hosting, email and accounting. The processors only process the information on our instructions and may not use it for their own purposes.
Transfers to countries outside the EU/EEA
As a general rule, we work with processors in the EU/EEA. If information is transferred to a country outside the EU/EEA, this only takes place on the basis of a European Commission adequacy decision that covers the recipient, or on the basis of the European Commission's standard contractual clauses together with any necessary supplementary measures. This applies, for example, to the backups stored with Google, which may be processed in the USA; Google LLC is certified under the EU-U.S. Data Privacy Framework. This also applies to the chat, where information may be processed by Intercom, Inc. in the USA, which is also certified under the EU-U.S. Data Privacy Framework. Contact us if you would like to know more about the safeguards or to receive a copy of them.
How long we keep the information
- Information about customers is kept for as long as the customer relationship is active. After that, we only keep it where this is necessary for specific purposes, for example bookkeeping or the handling of outstanding claims.
- Accounting records, for example invoices and payments, are as a rule kept for five years from the end of the financial year to which they relate (section 12 of the Danish Bookkeeping Act) and are then deleted.
- Enquiries via forms and attached files are kept for as long as is necessary to handle the enquiry and any customer relationship that results from it.
- Chat conversations are kept with Intercom according to the deletion settings we have chosen in Intercom, and otherwise only for as long as is necessary to handle the enquiry and any customer relationship that results from it.
- Feedback on guides is kept for as long as we use it to improve the guides.
- The server's access log is deleted after approximately 14 days, and searches in the search function are deleted after 12 months.
- The information for the visitor statistics is deleted after 35 days; after that only daily totals are kept.
- Backups of the website are deleted after 90 days, so deleted information may remain in the backups for up to 90 days.
- A free demo is deleted automatically after 30 days unless you continue with it.
Your rights
You have the right of access to the information we process about you and to receive a copy of it.
If you believe that the information is inaccurate, you have the right to have it corrected. In some cases, we are obliged to delete your personal data if you ask us to. This may be the case, for example, if your data is no longer necessary for the purpose for which we were to use it. Where the conditions of the General Data Protection Regulation are met, you also have the right to have the processing restricted and to receive the information you have provided to us in a structured, commonly used and machine-readable format (data portability).
Right to object: You have the right to object, on grounds relating to your particular situation, to processing that we carry out on the basis of our legitimate interests.
You can also contact us if you believe that your personal data is being processed in breach of the law. You can write to us at info@goldenplanet.com. You can also lodge a complaint with Datatilsynet (the Danish Data Protection Agency), Carl Jacobsens Vej 35, 2500 Valby, Denmark, www.datatilsynet.dk (opens in a new tab), or with the data protection authority in the EU country where you live or work.
Do you have to give us the information?
The information in an order is necessary to enter into and perform the contract; without it, we cannot provide our services. We do not make decisions based solely on automated processing, including profiling, which produce legal effects concerning you or similarly significantly affect you.
When Golden Planet is a processor
We process information about the customers of an online shop on our platform on behalf of the owner of the online shop, who is the controller, under our data processing agreement. If you are a customer of an online shop, you should therefore contact the online shop about your information.
